Standard Terms and Conditions (T&Cs) for orders placed online at Hana-Elegance.de

We would like to familiarise you below with our standard terms and conditions, which govern how we process and settle your purchases.

1. Formation of contract and delivery of merchandise

The purchase contract is concluded with Hana Eleganz Schal.

For orders placed online at hana-elegance.de, we enter into German or English language contracts only. You can choose your preferred language by using the language selector in the header of the website.

The contract is formed by clicking on the order button which indicates your acceptance of our offer concerning the goods contained in your  shopping cart. Once you have sent your order you will immediately receive a confirmation and via email.

2. Accuracy of information on the Site:

We do our best to ensure that information on the Site is complete, accurate and current. Despite our efforts, however, information on the Site may occasionally be inaccurate, incomplete, or out of date. All specifications, products, descriptions and prices of products on the Site are subject to change at any time without notice. We make all reasonable efforts to accurately display the attributes of our products, including the applicable colors. However, the actual color you see will depend on your device system, and we cannot guarantee that your device will accurately display such colors. We do not warrant the accuracy or completeness of the information, content or material provided through the Site. 

The inclusion of any products or services on the Site at a particular time does not imply or warrant that these products or services at any time. We reserve the right to discontinue any product at any time.

3. Term of Sale

By placing an order with us, you are (i) offered to purchase a product, (ii) representing that all information you provide to us in connection with such an order is true and accurate and you are an authorized user of the payment method provided. The receipt by you of an order confirmation does not constitute our acceptance of an order. We retain the right to refuse any order request made by you.

Please note that items ordered will be dispatched as soon as we receive payment of the full purchase price and any shipping costs.

4. Prices, shipping costs and express delivery

4.1 The prices set out in the offer as at the date on which the order is placed shall apply. The stated prices include German value added tax at the applicable statutory rate. The merchandise remains our property, as the case may be, until full payment of the purchase price.

4.2 We calculate the costs of shipping depending on the size and weight for your order. The Shipping cost will appear automatically in the shopping cart. 

Merchandise will be delivered within 4 working days at the latest. If the merchandise does not arrive within that delivery period, we will help you track the shipment to know where it is.

4.3. Damage during delivery: If the consumer received the goods obvious damage caused during delivery, please immediately report the defect to the carrier and notify us.

5. Payment

5.1 We generally accept the following payment methods: 

• SOFORT Online bank transfer „you must have an online banking account with PIN/TAN process for participating in SOFORT“
• Credit Card, Visa or Mastercard, 
• Payment through Paypal „you must be registered there or register first, identify yourself with your access data and confirm the payment instructions to us“.

We reserve the right not to accept certain payment methods for a given order and to refer to other payment methods. You are responsible for any costs associated with money transactions.

5.2 In the case of credit card purchases, your card will be charged when we ship your order.

5.3 You consent to receiving invoices and credits solely in electronic form.

5.5 Retention of title: The goods shall remain our property until full payment is made.

6. Promotional vouchers and their redemption

6.1 Promotional vouchers are given out during advertising campaigns and are valid for a certain period of time.

6.2 Promotional vouchers can be redeemed once only in connection with an order, and only within the specified period. Certain brands may be excluded from the promotion. Please note that a minimum order value may apply to the use of promotional vouchers.

6.3 If the voucher does not cover the value of the merchandise, the difference can be paid using any of the accepted payment methods. The value of promotional vouchers will not be paid out in cash, nor will it accrue interest. Promotional vouchers will not be refunded if all or some of the merchandise is returned.

6.4 Promotional vouchers can only be redeemed before the ordering process is complete. It is not possible to apply vouchers retrospectively. Promotional vouchers may not be transferred to third parties. 

6.5 If you used a promotional voucher when making your purchase and, as a result of revocation by you, the total value of your order is less than or equal to the value of the promotional voucher, we reserve the right to charge you the original price for the merchandise you retain.

7. Statutory right of revocation in respect of our merchandise

You have the right to revoke this contract within 14 days. The period of revocation is 14 days from the day on which you, or a third party designated by you (but who is not the carrier), took possession of the merchandise.

You may complete and submit the revocation form online through the contact form on our website. Then we will send you a confirmation by email. You will be deemed to have complied with the revocation period if you send your notice of revocation before such period expires.

 

Consequences of revocation

If you revoke this contract, we are required to refund all payments we received from you, excluding delivery costs. Refunds will be processed using the same method of payment, which you used, for the original transaction. We will not charge you any fees for the refund. We may hold off completing your refund until we have received the merchandise back.

You are obliged to return or hand over all merchandise to us without undue delay, but at least within 14 days from the day on which you gave us your notice of revocation of this contract.

8. Intellectual Property

The Site and all of its materials, including, but not limited to, its software or HTML code, scripts, text, artwork, photographs, images, video, and audio (collectively, "Materials" ) are protected by copyright laws and other German law, and international laws and treaties and are property of Hana Elegance or its licensors. All Materials are provided through the Site as a service to its current and prospective visitors and may be used only for personal and informational purposes and only if you also retain all copyright and other proprietary notices contained on the Materials. No right, title or interest in Hana Elegance Materials is conveyed to you. You may not copy, reproduce, publish, transmit, distribute, perform, display, post, modify, create derivative works from, sell, license or otherwise exploit the Site or any of its Materials without our prior written permission; you may not access or use the Site for any competitive or commercial purpose; nor may you permit any copying of our Materials. Any unauthorized copying, alteration, distribution, transmission, performance, display, or other use of these Materials is prohibited. Any and all rights not expressly granted are reserved by Hana Eleganz Schal, as applicable.
